Terms of Service

1. Agreement to Terms

By accessing or using the MailRivo software ("Software"), operated by Sadnan Rashid, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Software. MailRivo is provided as a self-hosted solution for email marketing and automation.

2. Description of Service

MailRivo provides a self-hosted email marketing interface. Users are responsible for providing their own infrastructure (servers) and email delivery services (SMTP providers). MailRivo does not provide email sending services directly but acts as a management layer for your own mailing operations.

3. License Grant & Restrictions

Subject to your compliance with these Terms, MailRivo grants you a non-exclusive, non-transferable license to use the Software.

• You may not redistribute, sell, or sublicense the Software to any third party.
• You may not reverse engineer, decompile, or attempt to extract the source code of the Software.
• Your license is tied to your account verified via Clerk and your purchase on Dodo Payments.
• Sharing license keys publicly or with unauthorized users will result in immediate revocation of your license without refund.

4. Data Ownership & Responsibility

As a self-hosted solution, you maintain 100% ownership of your data, including subscriber lists, campaign content, and analytics.

You are solely responsible for:

• The security and backups of your own server environment.
• Compliance with local and international laws (e.g., CAN-SPAM, GDPR).
• The content of any emails sent through the Software.

5. Payments & Refund Policy

All transactions are processed through Dodo Payments.

• We offer a 7-day refund window from the date of original purchase.
• Refund requests must be submitted via email to hello@mailrivo.com.
• After the 7-day window has elapsed, no refunds will be issued under any circumstances.

6. Prohibited Conduct

You agree not to use the Software to:

• Send unsolicited bulk email (SPAM).
• Distribute malware, viruses, or any other harmful code.
• Engage in any activity that is illegal, fraudulent, or deceptive.
• Circumvent any technical limitations or licensing checks in the Software.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

8. Limitation of Liability

In no event shall MailRivo be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business reputation, arising out of your use or inability to use the Software.

9. Indemnification

You agree to indemnify and hold harmless MailRivo from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) resulting from your use of the Software or your violation of these Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Bangladesh.

11. Termination

We reserve the right to terminate or suspend your access to the Software and revoke your license key immediately, without prior notice or liability, if you breach these Terms of Service.
